Associated Student Government (ASG) President Marion Chavarria Rivera was placed under review by the ASG Executive Board during an Executive Board meeting on Tuesday, April 21.
This action was brought to the attention of the ASG Senate the following Thursday by Eniya Pendleton, who serves as the Elections Committee Chair and Chief Justice for the student government.
“As an act of transparency I wanted to bring this to your attention, and I’m going to do my best to keep you all updated on the situation, but that is all I have right now,” Pendleton said.
The reasoning for placing Chavarria Rivera under review is unclear at this time, as Pendleton declined to share anything further. However, the bylaws state that the performance review process should be implemented “for failure to faithfully execute their outlined duties, improper professional behavior, or misuse or abuse of power or authority.”
In response to a follow-up question, Pendleton indicated that the ASG Executive Board is inclined to make public the reasons for Chavarria Rivera’s performance review, although no exact timeline is set.
“While we are not required to reveal the reasons for performance review, and while no formal decision has been made regarding whether or not we will release them, I can say with some likelihood that it will be released,” Pendleton said. “This will almost certainly not happen until the performance review process is complete, so that when we do make our official announcement all the facts can be presented, such that there is as little ambiguity as possible.”
This action sets in motion a series of events outlined in the “Review Process Bylaws of the Associated Students of the University of San Diego.” Article IV outlines the specific actions to take, which include the President meeting with the Director of Student Affairs to create a plan of action to be reviewed by the Executive Board.
According to the bylaws, the review process is intended to take two weeks. At this point in the semester, those two weeks would end just two days before the last ASG Senate meeting of the term, when Chavarria Rivera’s tenure would effectively be over.
The USD Vista reached out to Chavarria Rivera for a statement, but she said that she was unable to comment on the situation at this time.
If students have questions about what this process entails they can contact the ASG Executive Board, their residential senator, or their academic senator. The next ASG Senate meeting will be held via Zoom on April 30, beginning at 12:15 p.m. PST.
